2. Price

The prices of the items are as set out on the website and the confirmation of order. The prices are in Pound Sterling and include all taxes or other duties due in the UK. Postage and packaging costs are dependent on the size and weight of the item and the postage destination. The postage cost will be confirmed with the customer and added to the invoice before the invoice is sent.

3. Descriptions and Availability

3.1 All items are described as fully and accurately as possible. Woodblock prints are handmade products and as such, no single print is pristine and flawless and no two prints are the same. The hand-made paper used also has many natural features and blemishes of its own. The classification of condition and impression is also very subjective. Please refer to the images provided or email us if you are unsure about any of the terms used in the descriptions.
3.2 Items listed on the site as available can be ordered and paid for immediately using Google Checkout. All items listed as available are in stock in the UK and ready to be dispatched upon completion of an order. Should an ordered item be unavailable we shall advise you of that fact, you may cancel the order immediately and a full refund will be made.

4. Completing the Contract

4.1 When you complete your details and the details of the goods which you wish to purchase, and submit them to us, you are offering to purchase the goods at the price shown on the website subject to these terms and conditions.
4.2 The contract for the sale by us to you of the goods is completed when we have taken payment for those goods.
4.3 A confirmation of your order will be sent by e-mail on submission of the order.
4.4 We reserve the right at our discretion to refuse to complete a contract for the sale of goods to you.

5. Payment

Payment is made by credit or debit card through a secure external server managed by Google Checkout. Other payment methods, such as Paypal or personal cheque, are available on request.

6. UK Delivery

6.1 Once your order has been confirmed by us and payment completed, your goods will be despatched to you within 2 working days, unless otherwise stated.
6.2 Delivery of goods within the UK will be to the address specified by you at the time of order only and will take place on a week-day by Royal Mail first class recorded delivery or next day insured special delivery for orders over £500. Delivery times are not guaranteed. If the address you supply has any mistake causing the delivery company to be unable to deliver the package, we will send your purchase again, but a further shipping cost will then be chargeable.
6.3 A signature will be required to acknowledge delivery. The signature of the person accepting delivery at the delivery address will be proof that you, or the person to whom the order is addressed, has received the delivery.

7. Delivery Outside the EEC

7.1 When ordering goods for delivery outside the EEC you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from kokorojapaneseart.co.uk, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods. You should be aware that products despatched internationally are subject to opening and inspection by customs authorities.
7.2 Your order should be despatched from our premises within 2 working days of receipt of payment. From that point onwards the delivery time will be as is normal for international airmail.

8. Cancellation of Orders & Returns

8.1 You have a right to cancel your order within seven working days of receiving the goods. The seven day period begins upon the date of delivery of the goods to you.
8.2 In order to cancel your order, you must notify us by email or in writing within this 7 day period. A refund will be made within 30 days of your cancellation, subject to the return of the goods in perfect condition within that period of time. If you have paid for the goods by credit or debit card, your credit or debit card account will be re-credited as soon as possible and in any event within the above 30 day period.
8.3 If you cancel your order you must take good care of the goods and must return them to us at your own expense. Non-faulty goods must be returned in their original packaging and condition via registered mail. We will refund full cost less any carriage costs incurred by ourselves within 30 days of cancellation of your order. If the goods have been damaged whilst in your possession then we will be unable to refund you.

9. Claims

You should examine the goods upon receipt. If the goods are faulty or damaged you must notify us at the contact address in clause 1, within seven working days of receipt. We may request written details and a photograph of the damage from you. We will offer a full refund if satisfied with your claim. This only applies to damage not described in the profile of the item, not clearly visible from the image of the item or not reasonably expectable for such an item (eg. for a 100 year old print, aging of the paper can be expected). Please refer to point 3.1 of the Terms and Conditions.

10. Law and Jurisdiction

10.1 The contract shall be governed by English law and we and you consent to the exclusive jurisdiction of the courts of England and Wales. If you access the website from locations outside of England and Wales you are responsible for complying with any laws applicable to that territory.
10.2 Intellectual Property: This site is the copyright of Kokoro Japanese Art and all intellectual property rights in relation to its contents belong to Kokoro Japanese Art. All copying or reproduction of it in any form is prohibited.
